Synopsis: This seminar will review the recent case law that indicates when a bank is likely to be held to have assumed responsibility to advise its customer as to the suitability of a transaction. Key questions for consideration include: When does the bank "cross the line" between providing information and giving advice? What is the content of an advisory duty? What measures can the bank put in place to reduce the risk of an advisory duty arising in the first place?
